Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the LicensePlateData website, APIs, vehicle data services, software, reports, applications, and related products and services (collectively, the "Services").

LicensePlateData is operated by TYMAN SOLUTIONS LLC ("LicensePlateData," "we," "us," or "our").

By creating an account, purchasing Services, accessing an API, submitting a request, or otherwise accessing or using the Services, you ("Customer," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are accessing or using the Services on behalf of a company, organization, government agency, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, you may not access or use the Services.

Services

LicensePlateData provides vehicle-data products and services, which may include, without limitation:

  • License Plate-to-VIN lookup services;
  • VIN decoding services;
  • Vehicle specifications and attributes;
  • Vehicle images;
  • Vehicle history information and reports;
  • Application Programming Interfaces ("APIs");
  • Web-based applications and portals; and
  • Other vehicle-related data products and services.

The availability, scope, coverage, response fields, data sources, functionality, and pricing of individual Services may change from time to time.

Certain Services may also be subject to an order form, invoice, Enterprise Agreement, Data Processing Agreement, service agreement, or other written agreement between LicensePlateData and Customer.

If a separately executed written agreement conflicts with these Terms, the separately executed agreement will control with respect to the subject matter of that agreement.

Accounts and Registration

Certain Services require an account.

You agree to provide accurate, current, and complete information when creating and maintaining your account.

You are responsible for all activity occurring through your account and for ensuring that your employees, contractors, agents, and authorized users comply with these Terms.

You may not create accounts using false information, impersonate another person or entity, or create accounts for fraudulent, abusive, or unlawful purposes.

LicensePlateData reserves the right to refuse registration, require additional verification, or suspend or terminate accounts where reasonably necessary to protect the Services, LicensePlateData, its customers, data providers, or third parties.

API Credentials and Account Security

API keys, passwords, client identifiers, client secrets, access tokens, JWT credentials, authentication credentials, and other account credentials ("Credentials") issued by LicensePlateData are confidential.

You are responsible for protecting your Credentials and preventing unauthorized access to your account.

Credentials may only be used by the Customer to whom they were issued and by systems operating on that Customer's behalf.

You may not sell, transfer, publish, disclose, sublicense, or provide Credentials to any unrelated third party unless expressly authorized in writing by LicensePlateData.

You must promptly notify LicensePlateData if you know or reasonably suspect that your Credentials have been compromised, disclosed, stolen, or used without authorization.

LicensePlateData may revoke, replace, rotate, disable, or require the replacement of Credentials when reasonably necessary for security, compliance, fraud prevention, or protection of the Services.

Customer is responsible for API requests and other activity performed using Customer's Credentials until LicensePlateData has been notified of unauthorized access and has had a reasonable opportunity to disable the affected Credentials.

License to Use the Services

Subject to these Terms and payment of all applicable fees, LicensePlateData grants Customer a limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to access and use the Services for Customer's authorized internal business or personal purposes.

Commercial use of the Services is permitted where consistent with the Customer's applicable subscription, plan, order form, or agreement.

Except for Enterprise Accounts expressly granted resale rights, this license does not include the right to resell, sublicense, redistribute, commercially provide, or otherwise make the Services or data obtained through the Services available to third parties as a product or service.

API Usage and Request Limits

Access to LicensePlateData APIs may be subject to request allocations, monthly limits, rate limits, concurrency restrictions, endpoint restrictions, or other technical limitations.

Unless otherwise stated in Customer's applicable plan or written agreement, an API request submitted to LicensePlateData may count toward Customer's usage allocation regardless of whether the request returns a successful match, no match, error, incomplete record, or other response.

Customer may not attempt to circumvent request limits, rate limits, authentication requirements, usage restrictions, security controls, or technical limitations.

LicensePlateData may temporarily throttle, restrict, or suspend API traffic that threatens the security, stability, availability, or performance of the Services.

Payments and Billing

All fees are stated and payable in United States dollars unless otherwise agreed in writing.

Services may be prepaid, subscription-based, usage-based, subject to a monthly minimum commitment, or billed according to a separately agreed pricing arrangement.

Unless otherwise stated in writing:

  • Fees are non-refundable;
  • Purchased or allocated requests have no cash value;
  • Unused monthly request allocations expire at the end of the applicable billing period;
  • Unused requests do not roll over into future billing periods; and
  • Customer is responsible for applicable taxes associated with its purchase or use of the Services.

Some accounts may have a minimum monthly request commitment. Customer will be billed for the applicable minimum commitment regardless of whether the entire request allocation is used.

Access to prepaid request allocations may not be provided until payment has been successfully received.

LicensePlateData may suspend access to the Services for unpaid or delinquent balances.

Enterprise or custom accounts may be subject to different minimum commitments, overage pricing, invoicing terms, payment deadlines, or other billing arrangements specified in an applicable agreement, order form, or invoice.

Data Source and Accuracy

Vehicle information provided through the Services may be obtained, derived, compiled, calculated, normalized, or aggregated from governmental agencies, public records, industry participants, manufacturers, commercial data providers, non-profit organizations, and other public and private sources.

LicensePlateData does not control all underlying data sources.

Vehicle information may therefore be incomplete, inaccurate, delayed, outdated, unavailable, inconsistent, or contain errors or omissions.

LicensePlateData does not warrant or guarantee that information returned through the Services is complete, current, accurate, or suitable for any particular purpose.

A successful license plate, VIN, or vehicle lookup does not constitute an official motor vehicle record and does not establish current registration status, legal ownership, possession, location, or association between any particular individual and vehicle.

Customers are responsible for independently verifying information where accuracy is material to a transaction, decision, safety matter, legal obligation, or business process.

Permitted and Prohibited Uses

Customers may use the Services only for lawful purposes and in accordance with these Terms and all applicable laws and regulations.

Customers may not use the Services to:

  • Violate any federal, state, local, or international law or regulation;
  • Harass, stalk, threaten, intimidate, or unlawfully monitor another person;
  • Obtain or attempt to obtain personal information about an individual for an unlawful purpose;
  • Facilitate fraud, identity theft, deceptive practices, or other unlawful conduct;
  • Circumvent security controls, authentication mechanisms, usage limits, or rate limits;
  • Probe, scan, test, or exploit vulnerabilities in LicensePlateData systems;
  • Interfere with or disrupt the operation or security of the Services;
  • Reverse engineer, decompile, disassemble, or attempt to discover non-public source code, systems, algorithms, or methods used by LicensePlateData;
  • Use automated methods to scrape the LicensePlateData website outside of authorized API access;
  • Systematically harvest data for the purpose of recreating or developing a competing vehicle-data database or service;
  • Share Credentials with unrelated third parties;
  • Misrepresent data obtained through LicensePlateData;
  • Remove proprietary notices, attribution, trademarks, or copyright notices where such notices are required; or
  • Resell, sublicense, redistribute, or commercially provide the Services except as expressly authorized under an Enterprise Account or separate written agreement.

LicensePlateData reserves the right to investigate suspected violations of this section.

Legal Compliance and Vehicle Information

Customer is solely responsible for determining whether its intended access to and use of vehicle information is lawful.

Customer agrees to comply with all applicable federal and state laws governing vehicle records, privacy, consumer information, data protection, and permissible uses of information, including, where applicable, the Driver's Privacy Protection Act ("DPPA"), 18 U.S.C. §§ 2721–2725.

Customer may not use LicensePlateData to obtain information that Customer is not legally authorized to obtain or use.

Customer is responsible for maintaining any consent, authorization, permissible purpose, documentation, or other legal basis required for Customer's use of information obtained through the Services.

LicensePlateData does not provide legal advice regarding whether Customer's particular use of vehicle information satisfies applicable legal requirements.

Fair Credit Reporting Act

LicensePlateData is not a "consumer reporting agency" as defined by the Fair Credit Reporting Act ("FCRA"), and the Services are not intended to constitute or provide "consumer reports."

Information obtained through the Services may not be used, in whole or in part, to determine or evaluate a person's eligibility for:

  • Credit;
  • Insurance underwriting or eligibility;
  • Employment;
  • Housing or tenancy;
  • Government benefits, licenses, or privileges; or
  • Any other purpose regulated as a consumer report under the FCRA.

Customer may not use information obtained through LicensePlateData to unlawfully discriminate against any person or otherwise affect a person's economic or financial status in violation of applicable law.

Vehicle History Reports

Where LicensePlateData provides Vehicle History Reports ("Reports"), Customer receives a limited, revocable, non-exclusive, and non-transferable license to access and use those Reports according to Customer's applicable plan or agreement.

Unless expressly authorized in writing, Customer may not reproduce, modify, publish, sell, sublicense, redistribute, commercially exploit, or operate as a service bureau using the Reports.

Reports are compiled using information obtained from various governmental, industry, commercial, public, and private sources.

LicensePlateData does not guarantee that a Report contains every accident, title event, odometer reading, ownership event, service record, damage record, or other event relating to a vehicle.

A Report should not be used as a substitute for an independent vehicle inspection, title examination, mechanical inspection, or other appropriate due diligence.

Intellectual Property

The Services, website, APIs, documentation, software, graphics, designs, logos, trademarks, service marks, databases, compilations, methodologies, and other proprietary materials made available by LicensePlateData are owned by or licensed to LicensePlateData and are protected by applicable intellectual property laws.

Except for the limited rights expressly granted under these Terms, no rights or licenses are granted to Customer.

Customer may not copy, reproduce, modify, distribute, publish, create derivative works from, reverse engineer, commercially exploit, or otherwise use LicensePlateData intellectual property except as expressly permitted by these Terms or a separate written agreement.

Nothing in these Terms grants Customer the right to use the LicensePlateData name, trademarks, logos, branding, or other identifiers without prior written authorization.

Third-Party Services and Information

The Services may contain information obtained from or links to third-party websites, services, databases, applications, or data providers.

LicensePlateData does not control third-party services and is not responsible for their availability, accuracy, security, policies, content, or practices.

The inclusion of third-party information or links does not constitute an endorsement, partnership, sponsorship, or warranty concerning that third party.

No Unauthorized Resale

Unless Customer maintains an active Enterprise Account with resale rights or has received separate written authorization from LicensePlateData, Customer may not directly or indirectly resell the Services or data obtained from the Services.

For purposes of these Terms, "Resale" includes directly or indirectly providing, exposing, distributing, sublicensing, or making the Services or data obtained from the Services available to a third party as part of:

  • A standalone product or service;
  • An API;
  • A software platform or application;
  • A white-label product;
  • A report or data product;
  • A subscription or service package;
  • An affiliate or partner offering; or
  • Any other commercial product or service through which a third party receives the benefit of LicensePlateData Services.

A Customer may not avoid this restriction by bundling LicensePlateData data with other products or services.

Providing LicensePlateData functionality or results to Customer's own customers, affiliates, partners, resellers, or other third parties may constitute Resale even when LicensePlateData is not separately identified, advertised, or charged for.

Internal use of the Services by Customer's employees and authorized contractors solely for Customer's own business operations does not constitute Resale.

Enterprise Resale Rights

Resale rights are available only to Customers maintaining an active Enterprise Account in good standing or Customers otherwise expressly authorized by LicensePlateData in writing.

Subject to the applicable Enterprise Agreement and these Terms, LicensePlateData may grant Enterprise Customers a limited, revocable, non-exclusive, and non-transferable right to incorporate or bundle LicensePlateData Services into the Enterprise Customer's products or services.

Enterprise resale rights do not automatically permit unrestricted redistribution of LicensePlateData data or APIs.

Unless expressly authorized in writing, Enterprise Customers may not:

  • Sell or expose raw, unmodified API access;
  • Provide third parties with LicensePlateData Credentials;
  • Permit third parties to bypass the Enterprise Customer and directly access LicensePlateData systems;
  • Circumvent request limits, security controls, or rate limits;
  • Misrepresent the source, nature, scope, completeness, or accuracy of LicensePlateData information;
  • Permit downstream customers to use the Services unlawfully; or
  • Resell LicensePlateData Services in a manner that directly competes with LicensePlateData without prior written approval.

LicensePlateData may require different pricing, minimum commitments, usage limits, or contractual terms where Customer's use constitutes resale, redistribution, white-labeling, sublicensing, or other third-party commercialization.

Enterprise Customers are responsible for the use of LicensePlateData Services by their downstream customers and must implement reasonable measures to prevent unauthorized or unlawful use.

LicensePlateData may request information reasonably necessary to verify compliance with Enterprise resale requirements.

Resale rights immediately terminate upon suspension, termination, expiration, or downgrade of the applicable Enterprise Account unless otherwise agreed in writing.

Suspension and Termination

LicensePlateData may suspend, restrict, or terminate Customer's access to some or all Services if LicensePlateData reasonably believes that:

  • Customer has violated these Terms;
  • Customer has failed to pay amounts when due;
  • Customer is engaging in unauthorized resale;
  • Customer's Credentials have been compromised;
  • Customer's activity presents a security or operational risk;
  • Customer's use threatens the stability or availability of the Services;
  • Customer's activity may violate applicable law;
  • Customer is engaged in fraudulent, abusive, or deceptive activity; or
  • Suspension is reasonably necessary to protect LicensePlateData, its customers, data providers, or third parties.

LicensePlateData may immediately suspend access where reasonably necessary to address security, fraud, abuse, legal compliance, or operational concerns.

Upon termination, Customer's right to access the affected Services immediately ceases.

Termination does not relieve Customer of payment obligations incurred before termination.

Changes to the Services and APIs

LicensePlateData continually develops and modifies its Services.

We may add, modify, replace, restrict, or discontinue features, endpoints, fields, datasets, sources, documentation, supported jurisdictions, rate limits, or other aspects of the Services.

Where commercially reasonable, LicensePlateData will attempt to provide advance notice of material changes expected to substantially affect existing API integrations.

However, immediate changes may be necessary because of security concerns, legal requirements, third-party data-source changes, technical issues, or circumstances outside LicensePlateData's reasonable control.

Customer is responsible for maintaining its integrations and ensuring compatibility with currently supported APIs and documentation.

Availability and Service Levels

LicensePlateData does not guarantee uninterrupted or continuous availability of the Services.

The Services may become unavailable because of maintenance, upgrades, outages, network failures, third-party provider failures, data-source interruptions, security incidents, circumstances beyond our reasonable control, or other operational reasons.

Unless expressly provided in a separately executed written agreement, no service-level agreement ("SLA"), guaranteed uptime percentage, response time, support response time, or availability commitment applies to the Services.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL INFORMATION, DATA, REPORTS, SOFTWARE, AND MATERIALS PROVIDED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

LICENSEPLATEDATA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AND AVAILABILITY.

LICENSEPLATEDATA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, COMPLETE, CURRENT, OR FREE FROM DEFECTS.

LICENSEPLATEDATA DOES NOT WARRANT THAT ANY PARTICULAR VEHICLE, LICENSE PLATE, VIN, IMAGE, RECORD, OR OTHER INFORMATION WILL BE AVAILABLE OR ACCURATE.

CUSTOMER USES THE SERVICES AND RELIES UPON INFORMATION OBTAINED THROUGH THE SERVICES AT CUSTOMER'S OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSEPLATEDATA, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND DATA PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOSS OF DATA, BUSINESS INTERRUPTION, OR COSTS OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF LICENSEPLATEDATA FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY CUSTOMER TO LICENSEPLATEDATA FOR THE APPLICABLE SERVICE DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF LICENSEPLATEDATA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow certain limitations of liability, in which case the limitations above will apply only to the maximum extent permitted by applicable law.

Indemnification

Customer agrees to defend, indemnify, and hold harmless LicensePlateData, their affiliates, officers, directors, employees, contractors, licensors, and data providers from and against third-party claims, damages, liabilities, judgments, losses, penalties, costs, and reasonable attorneys' fees arising out of or relating to:

  • Customer's use or misuse of the Services;
  • Customer's violation of these Terms;
  • Customer's violation of applicable law;
  • Unauthorized resale or redistribution of the Services;
  • Customer's products, applications, platforms, or services incorporating LicensePlateData Services;
  • Customer's violation of privacy, vehicle-record, consumer-protection, or data-use laws; or
  • Customer's infringement or violation of the rights of another person or entity.

LicensePlateData reserves the right to participate in the defense of any matter subject to indemnification.

Confidentiality

Non-public information concerning LicensePlateData's technology, pricing, security procedures, API architecture, Credentials, documentation designated as confidential, data-provider relationships, business practices, or other proprietary information shall be treated as confidential where a reasonable person would understand the information to be confidential.

Customer may use such information only as necessary to use the Services and may not disclose it to third parties except to employees, contractors, or professional advisors who have a legitimate need to know and are subject to appropriate confidentiality obligations.

Changes to These Terms

LicensePlateData may update these Terms from time to time.

The current version will be made available on the LicensePlateData website and will identify the date it was last updated.

Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.

Where required by applicable law or where LicensePlateData determines that a change materially affects Customer's rights or obligations, LicensePlateData may provide additional notice.

Force Majeure

LicensePlateData shall not be liable for delays, interruptions, failures, or inability to perform resulting from circumstances beyond its reasonable control, including natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, governmental actions, labor disputes, utility failures, telecommunications failures, Internet outages, cyberattacks, denial-of-service attacks, failures of hosting providers, failures of third-party data providers, or similar events.

Assignment

Customer may not assign or transfer these Terms or its rights to use the Services without LicensePlateData's prior written consent.

LicensePlateData may assign or transfer these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, financing transaction, or transfer of the applicable business.

Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

Waiver

Failure by LicensePlateData to enforce any provision of these Terms shall not constitute a waiver of that provision or LicensePlateData's right to enforce it in the future.

Entire Agreement

These Terms, together with the Privacy Policy and any applicable order form, Enterprise Agreement, Data Processing Agreement, or other written agreement incorporated by reference, constitute the agreement between Customer and LicensePlateData concerning the Services.

They supersede prior discussions or communications concerning the same subject matter, except for separately executed agreements that expressly remain in effect.
